    hello

    Im attempting to find resolution in a child custody case with my ex partner. she seems to find reasons why mediation wont work and now syas it due to a power differential. Any suggestions. id just like to work towrds a colabortive effort towards raising our daughter. separated. We have a custody evaluation and a psyche eval about to happen. thanks

      Thanks for your question Josh. It sounds like you want to work towards a resolution using collaborative or mediative conflict resolution and your ex-partner is not open to it. It’s hard to convince someone to do something they don’t want to do. There are two issues here that I’d like to address. The first is the issue of mediation and when it works and doesn’t work. Mediation works best when both parties are invested in and committed to the process. People are more willing to follow the parenting plan when they created it. Mediation doesn’t work in cases of substance abuse, mental illness and in cases where there is a power differential. In some cases that can look like domestic abuse. If your ex-partner is saying there is a power differential, they she may not feel she will have a voice in the mediation process or she may not feel safe, in which case it would not be appropriate for you both.

      The good news for you is that you still can raise your daughter in a collaborative manner regardless of how the separation happens. As long as you both continue to put your daughter’s needs and best interests first, the two of you can collaborate on raising her. I know that is much easier said than done. There are plenty of resources out there to assist you on the co-parenting end of this difficult and stressful situation. I strongly urge you to tap into them.
